This Privacy Notice does not cover information you provide to independently owned and operated 3rd party retail stores. This Privacy Notice also does not cover personal information that we collect about employees, job applicants, and contractors relative to their employment or engagement with us.
General Audience
You must be 18 years or older and the age of majority in your place of residence to use, subscribe to, or register for the Service as a member. The Service is a general audience site and we do not knowingly collect, maintain or disclose personal information from or about children. If you create an account on our website, you will create user credentials, such as a user ID and password. All passwords are encrypted before being stored in our database. Endless Memorials cannot view passwords. Therefore, if you forget your password, we cannot send it to you via email or provide it to you by other means. If you forget your password, the “password reset” option on the website allows you to reset your password.
If you purchase any products or services through the website, your purchase is processed through a secure third-party payment processing system. Endless Memorials does not have access to or store any of your payment or financial information, including credit card numbers.
Depending on your interactions with us, we may gather some or all of the following data:
– Contact and personal details: your name, address, postal code, phone number, email address, user ID, gender, birth date, and any indicated interests;
– Billing Information: This includes credit/debit card information (number, expiry date, CVV code), alternative billing details, and billing address;

– Gift-related particulars: This involves recipients’ names, addresses, phone numbers, birthdates, email addresses, and included gift messages;
– Device details: Information about the devices used to access our services, including platform details, user identification numbers, and general device locations;
– Application data: Insights into the usage of your applications, including frequency and duration of use;
– Network insights: This encompasses IP addresses, network carriers, country codes, browsing behaviour, and interactions with our services;
– Additional data is provided through participation in our forums or User Submissions. Additionally, if you have an account on our platform, you may elect to include contact details in your Address Book for individuals to whom you plan to send gifts or expressions, and opt to receive reminders about important dates associated with them. It’s important to note that other users do not have access to view or edit your Address Book entries.
Technical Information
When you use our website, Endless Memorials automatically receives and records technical information on our server logs from your browser or mobile platform, including your location, IP address, and cookie information.
We gather your information through various means, including when you:

– Interact with our emails
– Make a purchase or receive a gift
– Participate in various activities such as forums, surveys, contests, promotions, and content submissions

- Do Not Track Disclosure. We do not track website visitors over time or across third-party websites to provide targeted advertising. Therefore, our website does not operate any differently when it receives Do Not Track (DNT) signals. The information we collect automatically is statistical data and does not include personal data.
A trusted third-party partner is Google Analytics. The website sends aggregated, non-personal Information to Google Analytics to provide Endless Memorials the ability to conduct technical and statistical analysis of the website’s performance. Your personal information will be deleted from our active systems within five business days of receiving your request; however, your personal information will be retained on our backup systems until deleted per our regular backup retention practices. If we need to restore information from a backup to our active systems, we will delete your personal information from the records restored to our active systems.
Administrator Access
Endless Memorials has access to view and manage all user profiles registered on our website. This means that we may have access to your personal information, including your name, email address, and any other information that you have provided.

E-Communications from Endless Memorials
Endless Memorials may send you emails or other electronic communications regarding us or our Services. These electronic communications will be sent to the email address that you provide to us. Should you wish to cease receiving these electronic communications, you can opt out via the instructions at Endless Memorials.
Endless Memorials will never send you an email requesting your password, credit card number, or social security number. F. Deletion Request Rights

- Make other internal and lawful uses of that information compatible with the context in which you provided it.
G. Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by contacting us. Only you, or a person registered with the California Secretary of State whom you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.
You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice in 12 months.
The verifiable consumer request must
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
H. Response Timing and Format
We endeavor to respond to a verifiable consumer request within 45 days of receipt. If we need more time (up to 90 days), we will inform you of the reason and extension in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12 months preceding the verifiable consumer request’s receipt. The response we provide will also explain why we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and allow you to easily transmit the information from one entity to another.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
I. Personal Information Sales Opt-Out and Opt-In Rights
You have the right to request that we do not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we know are younger than 13 years of age unless we receive affirmative authorization (the “right to opt-in”) from the consumer’s parent or guardian.
Consumers who opt into personal information sales may opt out of future sales at any time.
J. Nondiscrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny your goods or services;
- Charge you different prices or rates for goods or services, including granting discounts or other benefits or imposing penalties;
- Provide you with a different level or quality of goods or services; or
- Suggests that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
K. Other California Privacy Rights
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our site who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us.
